Este artigo procura lidar com as batalhas travadas pela memória na pós-transição democrática vivenciada pelo Chile a partir da análise do filme “Não”, de Pablo Larraín. O objetivo é pensar nas produções audiovisuais como um lugar privilegiado de disputa pela memória. Examinaremos como a obra, terceira de uma trilogia sobre a ditadura civil-militar chilena, procura retratar as campanhas do SIM e do NÃO antes do plebiscito de 1988, em que se decidiu sobre o destino da ditadura de Pinochet. Será analisada, (...) igualmente, a mistura que o filme faz de diferentes épocas históricas através de um amálgama entre imagens arquivísticas, personagens reais e cenas da ficção. (shrink)

O presente trabalho analisa a crise da legalidade sobre os aspectos da falência da legitimidade do Estado e da crise do Estado de Direito. Os poderes estabelecidos carecem de representatividade junto à população, que não credita mais à lei um meio de expressão da justiça. A hipótese averiguada demonstra que os pressupostos e técnicas da Legística possuem meios para o restabelecimento da credibilidade da lei no processo legislativo. Utilizou-se o método jurídico-dedutivo na pesquisa bibliográfica, com marco teórico na teoria do (...) Estado de Direito, de Jacques Chevallier e na Legística, que visa impulsionar a produção eficiente e eficaz da norma jurídica. (shrink)

O trabalho analisou as propostas legislativas do novo marco legal do setor mineral de 2013 a 2020 para descrever os seus avanços, retrocessos e tendências. No âmbito da vertente jurídico-descritiva de pesquisa, o estudo tem caráter diagnóstico, razão pela qual procedeu-se ao levantamento e análise de dados primários e secundários sobre o assunto sob a ótica da legística. Mesmo tendo sido aprovadas legislações sobre o tema, o novo marco legal do setor mineral não foi editado. This article derives from my participation in the II Congress of Childhood Studies: Politicizations and Aesthetics, held in September 2019, at UERJ/Maracanã. My speech entitled Childhoods, Culture and Intergenerational Relations in everyday life, was delivered in the conference “The ethnic-racial issue and the generational issue in childhood” having at its core extreme burning issues in Childhood Studies: both ethnic-racial and generational issues, arguing how these intersecting points have effects on the daily life of Brazilian children, especially children from the popular (...) classes who live in the outskirts of the big cities, such as the slums and urban borders of the state of Rio de Janeiro. In this pre-text, I chose to speak of this Other, named the child from the popular classes, the one who lives in the outskirts, in slums and popular areas. Those who, despite being infants deprived of speech, dare to speak among themselves and are spoken of by us, teachers and researchers of childhood. Considering our proposal of establishing conversation as a device for an encounter, I tried to speak of this Other, using my notes from the day of the conference, and the voices of authors with whom I dialogue in my studies, researches and daily work in different territories of the city, understanding the contemporary city as a place of encounters, both good and bad. Above all, the city is a place of intergenerational meetings where the co-existence is possible. (shrink)

The growth in international trade in recent years necessitates a better understanding of customs and expectations in cross-cultural negotiations. While several researchers have sought to examine and detail the similarities and differences between select countries, their data have generally been obtained under neutral or unspecified negotiating conditions. However, issue importance, opponent (prowess, ethical reputation), and context (location, confederate awareness, urgency) can play a significant role in the use of negotiating tactics. This paper describes a study comparing the perceptions of one (...) hundred and forty-two current and future business professionals from two emerging trade partners, Brazil and the United States, regarding the appropriateness and likely use of five categories of negotiation tactics under seven challenging or unfavorable negotiating conditions commonly faced by negotiators. The results indicate an overall conditional effect for both attitudes (perceived appropriateness) and intentions (likelihood of use). In addition, while no significant difference in perceived appropriateness was found due to country, there were differences in likely use due to country for six conditions-behaviors. (shrink)

Escrito en tiempos pandémicos, socializamos en el artículo los diálogos del Grupo Voces de la Educación con los movimientos docentes latinoamericanos que realizan investigaciones desde la escuela y la comunidad. Defendemos la pluralidad, diversidad y potencia de tales experiencias en la producción de otros procesos formativos, que nos llaman a la construcción de solidaridades necesarias para afrontar la barbarie de los tiempos actuales.

This study investigated teachers' views of forgiveness and institutional pardon for conflict resolution at schools. We asked, "Should teachers endorse student resolution of interpersonal conflicts at school by asking for forgiveness and forgiving?" "Considering that students' conflict led to behaviours that violated norms in the school, should schools pardon students' misconduct if students effectively used forgiveness for interpersonal conflict resolution?" Finally, "Is an internal and autonomous orientation for forgiveness related to social harmony or interpersonal ethics of care?" Fifty-three participants answered (...) a background information questionnaire and two dilemmas. Findings showed that teachers endorse forgiveness as social expectation, a humanitarian, moral response to conflicts at conventional levels. Teachers do not endorse institutional pardon because they do not perceive forgiveness as being related to resolving social issues. Opposition to forgiveness and pardon was supported by authoritarian, discipli narian views of education. (shrink)

Resumo O artigo pretende apresentar as principais linhas temáticas da poética de Adélia Prado, escritora que do primeiro ( Bagagem , 1976) ao último livro ( A duração do dia , 2010) tem surpreendido público e crítica com a articulação de temas que o senso comum considera divorciados, mais propriamente, uma religiosidade mística e uma erótica candente. Pensar o erótico e o místico em Adélia é pensar o humano circunscrito pelo horizonte da morte, sabendo-se que, mais do que uma temática, (...) esses são elementos estruturadores e sustentadores dessa poética que se enraíza em uma corporeidade extrema que assume corpo e linguagem como abertos para o sagrado. Entretanto, ainda que religiosa, sua poesia não é ingênua ou catequética e, a experiência mística, à semelhança do que acontece com os grandes místicos Teresa de Avilla e São João da Cruz, se dá no corpo, que se torna porta de abertura para o mistério: ' o mistério vai se mostrar através do corpo' , diz-nos uma das personagens adelianas. Palavras-chaves: Adélia Prado; Mística; Erotismo; Poesia.The article aims to present the main themes of the poetry of Adelia Prado, a writer who since the first book (Bagagem, 1976) to the last (A duração do dia, 2010) has surprised audiences and critics with the articulation of issues that common sense believes divorced, more properly, a mystical religiosity and a burning eroticism. Thinking about the erotic and the mystical in Adelia Prado´s poetry means thinking about human being as circumscribed by the horizon of death, knowing that more than a simple theme, these are elements of a structured and sustained poetry that is rooted in a extreme corporeality that assumes body and language as always open to the sacred. However, although religious, his poetry is neither naive nor catechetical. Such mystical experience, similar to what happens with the great mystics Santa Tereza de Avilla and São João da Cruz, takes place in the body, which becomes the gateway to the mystery. Images That Move is concerned with how images take place in wider worlds: how they move around, via processes of transmission and uptake, but, equally importantly, how they move their audiences affectively. Images play a significant part in projects of "poetic world-making" and political transformation. They participate in the production of commensuration or of incommensurability, enact moments of prophecy or exposure, and attract or repel spectators' attention. Images move, then, but not just as they wish, and any examination of images (...) in motion must also recognise the blockages and breakdowns that prevent their movement as well as the enframings or "stickinesses" that trap them in particular places, prevent them from reaching others, or hedge their arrival in specific ways. The contributors explore topics ranging from high art to mass media, religious iconography to pornography, and popular photography to political cartoons in a range of contexts and media including photography in early twentieth century China, art and literature in contemporary South Africa, upscale real estate development in India, occult media images and the aesthetic of appearance in urban Indonesia, and film censorship in Nigeria. All of these instances of the visual continuum require different ways of highlighting and addressing the problematics of images in motion. Images That Move traces some of the tangled paths of images' travels and returns, unfolding their effects and aftereffects and scanning the diverse and variable publics-fixed or ephemeral, situated or dispersed-that these moving images call into being. O presente artigo tem como objetivo apresentar as contribuições de Ludwig Wittgenstein à fundamentação do saber e prática psicológica. Isso será feito em dois movimentos fundamentais: em primeiro lugar, reconstruiremos os interlocutores de Wittgenstein e as questões que estavam pressupostas em cada um deles. Em segundo lugar, argumentaremos sobre o método analítico que Wittgenstein escolheu para lidar com essas questões. Isto significa, pelo menos, duas coisas: Wittgenstein assume que a linguagem descritiva é o padrão para a interlocução humana, mas que (...) também a linguagem expressiva tem seu lugar de importância, ainda que com ressalvas; essa distinção de gramáticas fundamentará o seu método de lidar com as questões psicológicas: através da interpretação e descrição do comportamento, entendido como manifestação externa das vivências internas, a terceira pessoa terá um acesso privilegiado às ocorrências da consciência da primeira pessoa. Concluiremos o trabalho com considerações críticas sobre os benefícios e as deficiências da abordagem wittgensteiniana. (shrink)

no conjunto imenso e nada sistematizado da filosofia de Slavoj Žižek, a noção benjaminiana de “violência divina” é recorrentemente articulada. Para os propósitos do presente artigo, que é pensar a introdução de um terceiro elemento destituinte da dialética da violência que põe e mantém o direito, nos valeremos três textos do filósofo esloveno: Robespierre, ou a “divina violência” do terror (2007), Violência divina (2008) e Da democracia à violência divina (2009). Nesse sentido, reconstruiremos o que está no centro da sua (...) argumentação em que Žižek se apropria do conceito benjaminiano, para em seguida, mostrarmos a inadequação de sua interpretação para pensarmos uma teoria do poder destituinte. Corremos o risco de afirmar uma inadequação, não pelos resultados que Žižek alcançou, mas porque ele arroga para si uma interpretação do conceito de Benjamin que em nosso entendimento não está próximo de sua argumentação. O presente trabalho buscará fazer uma breve fenomenologia da ação humana tendo como ponto de inflexão a concepção de trágico na ação, isto é, pensar a ação humana como portadora de aspectos trágicos que exigem de nós respostas e atitudes que geralmente os sistemas éticos clássicos não conseguem proporcionar. Esta concepção pode ser apresentada a partir de vários autores de épocas e lugares bastante distintos. Todavia, optaremos por buscar em dois, dos três grandes tragediógrafos gregos, uma perspectiva trágica da ação (...) humana para então examinarmos, a luz do pensamento de Friedrich Nietzsche e Hannah Arendt, possíveis modos de redenção aos infortúnios em que as ações humanas podem nos colocar. O artigo tem como objetivo apresentar os problemas teóricos e históricos ligados à compreensão da técnica moderna na filosofia de Martin Heidegger. Para tal investigação começaremos investigando sobre qual é a constituição da essência da técnica para que, então, possamos explorar o significado da técnica à luz de sua caracterização mais essencial. Isto nos dará condições de identificar quais sãos os riscos envolvidos na era em que a dominação técnica atingiu níveis nunca vistos antes. Tudo isto será questionado para que (...) possamos estabelecer, inspirados pelo pensamento de Heidegger, um modo de relacionamento livre com a técnica que nos permita uma redenção à regência da técnica como o modo de desencobrimento moderno. o presente trabalho procura investigar se existe algum elo de união que perpassa a crítica à civilização empreendida pelo filósofo alemão Walter Benjamin, bem como algo que passa necessariamente pela sua rejeição ao capitalismo, impulsionada tanto pelo romantismo alemão, pelo marxismo libertário quando pelo messianismo judaico. Em meio a um aparente aglomerado filosófico, nossa pergunta metodológica indaga-se pela possibilidade de falar de um fio condutor no pensamento do filósofo das inúmeras passagens e anotações fragmentadas? A hipótese que sustentaremos no presente (...) trabalho é que o messianismo de Benjamin percorre toda a sua obra, como uma corrente elétrica que alimenta e ilumina todos os seus escritos. (shrink)

This article investigates conceptions of morality within the framework of ressentimentful victimhood in the manosphere, while also exploring avenues for resistance among young individuals encountering the “hatred pipeline”. In Study 1, we use the emotional mechanism of ressentiment to examine how incels construct narratives of victimhood rooted in the notion of sexual entitlement that remains owed and unfulfilled, alongside its “black pill” variant emphasising moral and epistemic superiority. Through a linguistic corpus analysis and content examination of 4chan and Incel.is blog (...) posts, we find evidence of ressentiment morality permeating the language and communication within the incel community, characterised by blame directed at women, and the pervasive themes of victimhood, powerlessness, and injustice. In Study 2, we delve into young individuals’ reflections on incel morality and victimhood narratives as they engage with online networks of toxic masculinity in the manosphere. Drawing from semi-structured interviews with young participants who have accessed the manosphere, we explore their perceptions of risks, attribution of blame, and experiences of empathy towards individuals navigating the “hatred pipeline”. Our analysis underscores the significance of ressentiment in elucidating alternative conceptions of morality and victimhood, while shedding light on the potential for acceptance or resistance within online environments characterised by hatred. Debates about effective responses to the COVID-19 pandemic have emphasized the paramount importance of digital tracing technology in suppressing the disease. So far, discussions about the ethics of this technology have focused on privacy concerns, efficacy, and uptake. However, important issues regarding power imbalances and vulnerability also warrant attention. As demonstrated in other forms of digital surveillance, vulnerable subpopulations pay a higher price for surveillance measures. There is reason to worry that some types of COVID-19 technology might lead to the (...) employment of disproportionate profiling, policing, and criminalization of marginalized groups. It is, thus, of crucial importance to interrogate vulnerability in COVID-19 apps and ensure that the development, implementation, and data use of this surveillance technology avoids exacerbating vulnerability and the risk of harm to surveilled subpopulations, while maintaining the benefits of data collection across the whole population. This paper outlines the major challenges and a set of values that should be taken into account when implementing disease surveillance technology in the pandemic response. (shrink)

This paper examines dominant arguments advocating for the procreative right to undergo sex selection for social reasons, based on gender preference. I present four of the most recognized and common justifications for sex selection: the argument from natural sex selection, the argument from procreative autonomy, the argument from family balancing, and the argument from children’s well-being. Together these represent the various means by which scholars aim to defend access to sex selection for social reasons as a legitimate procreative choice. How does the concept of personal identity relate to the subject of the Phenomenology of Spirit? Throughout this “Bildungsroman,” the intersubjective, social, and institutional layers essential for the self become apparent. Tereza Matějčková proposes that the identity of the self rests in the person's ability to reappropriate norms, rituals, and intersubjective settings that he or she is a part of. However, identity is not essential at the level of consciousness since substantially, consciousness is negativity. As a person, the human (...) being is a consciousness of the self, where the self relates to the social and intersubjective realm and to consciousness as the negativity that makes meaning possible. Consequently, personal identity is conceived of as “personal difference,” which is the active relating of self and consciousness. Matějčková argues that Hegel's Phenomenology is not exclusively a Bildungsroman and that on the margins of the Bildungsroman, a “Kollapsgeschichte” evolves, which is a story where the protagonist learns that an essential part of one's personality is the ability to break with one's environment, occasionally even with one's self. English summary: Criticism is often levelled at Hegel's philosophy of the absolute spirit for its being conceived at the expense of the world. In view of this, Hegel's regular reference to a world in the Phenomenology of Spirit is somewhat puzzling. How then are we to understand the presence of the world, or even numerous worlds? Tereza Matejckova contends that at every stage of its journey, consciousness designs a new world-model, each built on central concepts of the respective form (...) of consciousness. Consciousness thus finds itself in a world of contradiction, of life, of struggle, or one of unhappy diremption. The point of absolute knowledge is not that the world is now derived from consciousness itself, but rather that it conceives a world-model that corresponds with reality, as whose reflection it itself now grasps. German description: Oft wird gegen Hegel der Vorwurf erhoben, seine Philosophie des absoluten Geistes sei auf Kosten der Welt konzipiert. Umso auffallender ist, dass Hegel in der Phanomenologie des Geistes nahezu auf jeder Ebene auf eine Welt zu sprechen kommt. Wie ist diese Gegenwart der Welt, sogar einer Mehrzahl von Welten zu deuten? Tereza Matejckova behauptet, dass das Bewusstsein auf jeder Ebene seiner Genese ein Weltmodell entwirft, in dessen Zentrum Schlusselbegriffe der einschlagigen Bewusstseinsgestalt stehen. Das Bewusstsein findet sich somit in einer Welt des Widerspruchs, des Lebens, des Kampfes oder der unglucklichen Entzweiung wieder. Pointe des absoluten Wissens ist nicht, dass das Bewusstsein nun die Welt aus sich selbst ableitet, sondern dass es ein der Wirklichkeit entsprechendes Weltmodell konzipiert, als dessen Widerschein es sich selbst erfasst. The concept of sex selection for “family balancing” is based on the notion that a family is “balanced” when it includes children of “both genders.” Clinics that offer IVF for family balancing present it as an option for couples who “want to experience the joy of raising both a male and female child”. Families with at least one child of each gender are claimed to have gender diversity and to provide more enriching experiences to all family members. The concept of narrativity and narrative identity has two birth certificates: it is linked to the phenomenological tradition—beginning with Arendt’s “political phenomenology” —and to the tradition of German Idealism gradually slipping into existentialism. In this article, the author focuses on the latter tradition that helped to pave the way of the concept of narrative self. Key among the thinkers of Classical German Idealism has been Hegel, often considered the philosophical storyteller. Yet the author argues that Hegel’s concept of narrativity is (...) not exclusively applied to the self and has hardly any role in the constitution of consciousness. This is the reason why Hegel has the means to formulate a more convincing concept of the self and personal identity. The author does not deny that narrativity is seminal, both for leading a life as a human being and as a concrete person; however, originally consciousness and self-hood are born out of negativity. One enacts one’s selfhood, once one realizes that one has to interrupt narrativity, step in, refuse to live by it, or just ordinarily rephrase it consciously and by this appropriate it. (shrink)

We analyze some normative relations as instances of a general schema of relations among a finite number of parties; in this schema parties can play various roles grouped into two main conceptual layers, called 'subject position' and 'object position'. Relying on the theoretical apparatus introduced, we develop a new symbolic representation for normative reasoning which constitutes an alternative to approaches available in the literature. Our contribution includes a semantic characterization for a series of logical systems built over the proposed framework.

This study focuses on the interrelation of freedom, finitude, and reconciliation in Hegel?s understanding of religion. These three moments are found at central stages of Hegel?s treatment of the religious, from Hegel?s early fragments to his mature work. Finitude taking shape in the religious phenomena of a tragic fate, sin, or more generally, failing, is central to Hegel?s philosophical understanding of one-sidedness. As finite, man needs to reconcile with the other, and only as reconciled does he achieve freedom. Hegel credits (...) Christianity with the discovery of the primary essences of spirituality: freedom and forgiveness. Freedom is intensified with the death of God: man realizes that there is no God-given, only man-made, legislation. This deepening of freedom does not overcome man?s finitude but instead intensifies it along with a heightened sense for responsibility, and an increased potential for guilt. Much has been said about the potential of digital health technologies for democratizing health care. But how exactly is democratization with digital health technologies conceptualized and what does it involve? We investigate debates on the democratization of health care with digital health and identify that democratization is being envisioned as a matter of access to health information, health care, and patient empowerment. However, taking a closer look at the growing pool of empirical data on digital health, we argue that these (...) technologies come short of materializing these goals, given the unequal health outcomes they facilitate. Building on this evidence, we argue that not only debates on democratization need to be connected to concerns of social determinants of health but also debates on the impact of digital health need to go far beyond democratization and engage with concerns of health justice. In the 1990s and early 2000s, researchers in the field of so-called neuoaesthetics recruited research subjects who had been untrained in arts and did not have any pronounced interest in aesthetic matters for their laboratory experiments. The prevalent choice of research subjects has recently changed. Currently, a great number of studies uses subjects who are professionally engaged in the art world. In my paper, I describe, analyze, and critically discuss the two research paradigms regarding the subjects involved in the experiments (...) in neuroaesthetics. I claim that although the more recent one can be generally regarded as an improvement of the research framework, it underestimates the difficulties brought by the notion of expertise in aesthetic perception. A review of Carolyn Korsmeyer´s Savoring Disgust: The Foul and the Fair in Aesthetics (New York: Oxford University Press, 2011, 208 pp. ISBN 978-0-19-975694-0).

Peasants of the northeastern Pará cultivate cassava (manioc esculenta) using shifting cultivation. This paper discusses some factors in support of cassava production, even though it has some negative environmental impacts. These factors are the importance of cassava in the region's history, dietary traditions, and the cooperative labor systems employed in its cultivation and processing.

In the Peruvian Amazon, tobacco (Nicotiana rustica) is considered a master plant and is the main curing tool of local healers. Among its several medicinal uses, we find drinking tobacco juice with the purpose of purging in order to heal on a physical, mental, and spiritual level. This specific practice is part of the addiction treatment protocol developed at Takiwasi Center. The goal of this investigation was to focus on the effects of the tobacco purge as reported by therapists at (...) Takiwasi and to elaborate its relevance within the context of addiction treatment. In order to obtain information on this topic, we performed research fieldwork based on a participant-observation approach, and retrospective data analysis on information from interviews conducted by psychotherapists with patients. As alleged effects of the tobacco purge, therapists reported that patients experienced feelings of mental clarity with the greatest frequency (n = 80), followed by noteworthy physical effects including discomfort and intoxication (n = 63). An effect on sleep and dreams was also common (n = 36) and many found the experience directly related to addiction treatment and the desire to consume substances (n = 20). (shrink)

Professionals and researchers in the literature widely discuss the concept of knowledge sharing. This article aims to provide a theoretical framework for knowledge sharing from the perspective of selected factors such as altruism and social exchange theory (SET) and also discusses an epistemological approach to knowledge management and knowledge sharing. The main aim of this paper is to theoretically and empirically contribute to knowledge sharing in the University context. The paper also discusses the altruism and knowledge sharing of students as (...) individuals who may expect some recognition for sharing their tacit and explicit knowledge. Data confirm that there is often an altruistic approach among students. If they expect recognition, it is mainly on a group level. Groups of student respondents also gave a unique perspective on the influence of the COVID-19 Pandemic on the attitude toward sharing knowledge. (shrink)
